An official cellphone previously used by Dr. Anthony Fauci during his tenure at the Department of Health and Human Services (HHS) has been delivered to the Senate Homeland Security Permanent Subcommittee on Investigations, led by Senator Ron Johnson (R-Wis.). It is currently uncertain whether the subcommittee has gained access to the device's contents.

This acquisition of the phone, initially reported by The Wall Street Journal, coincides with preparations by the Senate Homeland Security and Governmental Affairs Committee to consider a vote on holding Dr. Fauci in contempt of Congress. The development also follows the Department of Health and Human Services' recent provision of more than 1,000 pages from Dr. Fauci's personal diary to the panel, which occurred just days before a highly anticipated hearing.

Subpoena and Controversial Testimony

The aforementioned hearing, scheduled for Thursday morning, was prompted by a subpoena issued by the committee's chairman, Senator Rand Paul (R-Ky.). Senator Paul had compelled Dr. Fauci to provide testimony regarding his alleged involvement in financing "risky" gain-of-function research in Wuhan, China, a city identified as the origin point of the COVID-19 pandemic.

The testimony last week was widely anticipated as a climactic confrontation between Dr. Fauci and Senator Paul, who has publicly called for Dr. Fauci's imprisonment over his role in national pandemic policy and accusations of misleading Congress. However, the proceedings unfolded differently than expected.

Acting on legal counsel, Dr. Fauci chose to invoke his Fifth Amendment right against self-incrimination, expressing concerns that the panel's questioning was designed to trap him.

"Although it pains me to do so because of the respect I have for the legislative branch of government and my decades-long record of cooperating with Congress under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions," Fauci stated.

Committee Reactions and Future Legal Questions

Subsequently, Republican members of the committee posed a barrage of questions to Dr. Fauci, ranging from his purported involvement in a laboratory leak theory — which suggests the virus's rapid global spread — to more trivial inquiries. Democratic members, conversely, contended that Dr. Fauci's invocation of his constitutional rights was appropriate, given what they characterized as Senator Paul and his colleagues' determined effort to elicit a misstatement.

The session concluded with Senator Paul asserting that Dr. Fauci would face repercussions for his refusal to answer questions, and raising doubts about the extent to which a presidential pardon from former President Joe Biden might shield him.

"I think there's another legal question that the courts may have to decide upon, and that is whether or not a presidential pardon offers you complete immunity," Senator Paul remarked at the time.
